Lawsuit can put railroad out of business. In Canada railroad companies price their transport of dangerous goods to take that into account. A relative of mine was involved in an arbitration over this matter when customer tried to resist the pricing.

As an Ohioan that is just a prevailing wind shift from being within range of a carcinogenic fallout plume, I for one am just glad we spent $6 trillion on wars in Iraq and Afghanistan instead of upgrading our domestic rail infrastructure.
